  • Disconnecting accounts if you no longer wish to share data

5.2 Investment Platform Integrations

Connections to investment platforms (including but not limited to brokerage accounts) are subject to their respective terms and conditions. We are not responsible for the accuracy of data from these platforms or any trading restrictions or limitations they may impose.

5.3 Payment Processing

Payment processing is handled by Stripe, Inc. and subject to their Terms of Service. All subscription and payment terms are non-refundable unless otherwise specified.

6. Automated Features and User Consent

6.1 Automated Analysis

By connecting your accounts, you consent to automated analysis of your financial data to generate insights and suggestions. This includes but is not limited to:

  • Transaction categorization and spending analysis

  • Account balance and cash flow monitoring

  • Investment allocation analysis

  • Optimization opportunity identification

  • Goal tracking and progress monitoring

6.2 No Automated Execution Without Explicit Consent

EQUO will NEVER execute financial transactions, transfers, or investment actions without your explicit consent for each specific action. All automated suggestions require your approval before any execution.

6.3 Memory and Personalization

Our AI system uses memory technology to learn your preferences and provide more relevant suggestions over time. This data is used solely to improve your experience and is not shared with third parties for marketing purposes.

7. LIMITATION OF LIABILITY

IMPORTANT LIABILITY LIMITATIONS:

7.1 No Liability for Financial Losses

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EQUO SHALL NOT BE LIABLE FOR ANY FINANCIAL LOSSES, INVESTMENT LOSSES, MISSED OPPORTUNITIES, OR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:

Your use of or reliance on our Service or any information provided

  • Investment decisions made based on our suggestions or analysis

  • AI-generated recommendations or analysis errors

  • Third-party platform failures, data errors, or service interruptions

  • Security breaches, unauthorized access, or data loss

  • Technical failures, system downtime, or software bugs

  • Regulatory changes affecting financial strategies

  • Market volatility or economic events

7.2 Maximum Liability Cap

IN NO EVENT SHALL EQUO'S TOTAL LIABILITY TO YOU EXCEED THE TOTAL AMOUNT PAID BY YOU TO EQUO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS LESS.

7.3 Service Provided "AS IS"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8. Regulatory Compliance and Disclaimers

8.1 Regulatory Status

EQUO is not registered with the Securities and Exchange Commission (SEC), Financial Industry Regulatory Authority (FINRA), or any state securities regulator as an investment advisor or broker-dealer.

8.2 Compliance with Laws

Either party may terminate this agreement at any time. Upon termination:

  • Your access to the Service will cease immediately

  • All automated analysis and suggestions will stop

  • Connected accounts will be disconnected

  • Data retention will follow our Privacy Policy

  • No refunds will be provided for unused subscription periods

13. Dispute Resolution and Governing Law

These Terms are governed by Delaware state law without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
